End‑User Licence Agreement (EULA)

The Landscape Archive Pty Ltd (ABN 90 669 472 403)

This End‑User Licence Agreement (EULA) governs your use of any digital products purchased from The Landscape Archive, including 2D assets, 3D models, scenes, materials, textures, renders, tutorials, and any related files (“Landscape Archive Products”).

1. Glossary of Terms

  • Licensor – The Landscape Archive Pty Ltd.
  • Licensee – Any person or entity who purchases or uses Landscape Archive Products.
  • Landscape Archive Products – All digital files provided by The Landscape Archive, including 2D assets, 3D models, scenes, materials, textures, renders, tutorials, and related content.
  • Free Samples – Products provided at no cost for evaluation purposes only.
  • Licence – The non‑exclusive, non‑transferable, worldwide rights granted to the Licensee under this agreement.
  • Account / Portal – The secure customer area on the Landscape Archive website used to access purchased products.

2. Subject of the Agreement (Licence Grant)

Upon purchase and confirmation of payment (or upon download of a product), The Landscape Archive grants the Licensee a personal, revocable, non‑exclusive, non‑transferable licence to use the Landscape Archive Products subject to the terms of this EULA.

The Licensee may:

  • Install and store the files on their own devices.
  • Convert the files to other formats for personal or commercial use.
  • Use the files in renders, animations, games, real‑time visualisations, and similar projects.
  • Use the files for 3D printing, provided the original model files are not extractable or redistributable.

Important: Nothing in this EULA overrides any non‑excludable consumer rights under the Australian Consumer Law (ACL).

Free samples are provided for evaluation only and are subject to the same restrictions as paid products unless otherwise stated.

All intellectual property rights remain exclusively with The Landscape Archive. No transfer of ownership occurs.

3. Licence Restrictions (Critical)

The Licensee must NOT:

  • Resell, redistribute, sub‑licence, or share Landscape Archive Products with any third party (except as permitted for contractors under a single project, who must delete all files afterwards).
  • Upload files to public storage, servers, GitHub, marketplaces, asset libraries, or “kitbash” packs.
  • Reverse‑engineer, scrape, or scan assets to create new models or datasets.
  • Use assets for AI training, dataset creation, generative AI model fine‑tuning, or 3D/2D dataset expansion.
  • Convert assets into NFTs or blockchain tokens without prior written permission.
  • Incorporate assets into open‑source or royalty‑free libraries.
  • Use files in illegal, harmful, or otherwise objectionable content.
  • Deliver game builds or applications without reasonable obfuscation to prevent extraction of assets.

4. Licensee Responsibilities & Payment

All payments must be made in Australian Dollars (AUD). Prices displayed to Australian customers include GST where applicable. The Landscape Archive reserves the right to adjust pricing at any time. Due to the nature of digital goods, refunds are not provided for change of mind; however, your rights under the Australian Consumer Law remain unaffected.

5. Supply & Downloads

All products are delivered digitally. Licensees access their purchases through their Account on the Landscape Archive website. Download limits are applied to prevent abuse; these are reasonable and designed to permit legitimate access.

6. Consumer Guarantees, Refunds & Remedies (Australia)

If a product has a major fault, you are entitled to a refund or replacement. For a minor fault, we will provide a repair, replacement, or re‑supply. These rights are provided under the Australian Consumer Law and cannot be excluded. Refunds are not available for change of mind.

7. Breach and Termination

If The Landscape Archive reasonably believes a Licensee has breached this EULA, we may:

  • Notify the Licensee and require them to cease the breach;
  • Suspend the Licensee’s account;
  • Terminate the licence and block further downloads;
  • Require deletion of all copies of the product.

Upon termination, the Licensee must immediately delete all Landscape Archive Products from all devices and storage.

8. Privacy & Data

The Landscape Archive complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Personal data collected during purchase or account creation is used to fulfil orders, provide support, and communicate about services. Where data is stored overseas, we take reasonable steps to ensure it is protected.

9. GDPR / UK GDPR Addendum

For customers located in the European Union or United Kingdom, The Landscape Archive processes personal data under the lawful bases set out in the GDPR and UK GDPR. Affected individuals have rights to access, rectify, erase, restrict, port, and object to processing of their data. Transfers of data outside the EEA or UK are governed by Standard Contractual Clauses (SCCs), the UK International Data Transfer Agreement (IDTA), or the UK Addendum, as applicable. Security measures are maintained to protect personal data, and complaints may be lodged with the relevant supervisory authority.

10. Electronic Contracting

You agree that your digital acceptance (including clicking “I agree” or completing a purchase) is binding and valid under the Electronic Transactions (Victoria) Act 2000 and equivalent Commonwealth legislation.

11. Notices

Official communications will be sent via email to the address associated with your account or through your account dashboard. It is your responsibility to maintain a current email address.

12. Governing Law

This EULA is governed by the laws of Victoria, Australia. Both parties submit to the non‑exclusive jurisdiction of the courts of Victoria.

13. Assignment

The Licensee may not assign or transfer this agreement. The Landscape Archive may assign this agreement in the event of a merger, acquisition, or sale of assets.

14. General

If any part of this EULA is found to be unenforceable, the remainder remains in effect. This EULA constitutes the entire agreement between the parties and supersedes any prior agreements or understandings. We reserve the right to update this EULA; the version in force at the time of purchase governs your licence.
