By creating an account or accessing The Landscape Archive (“the Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not register or use the Platform.

2. Purpose and Scope of the Platform
The Platform provides access to plant data, imagery, documents, and related landscape design resources (“Content”). The Content is intended for reference, research, and educational use. The Platform does not provide professional horticultural, environmental, or legal advice.

3. User Eligibility
Registration is limited to individuals who:

Provide accurate and complete registration information.

The Platform may refuse or revoke access at its discretion.

4. Intellectual Property Rights

Users retain ownership of any materials they upload but grant the Platform a non‑exclusive licence to store, display, and use such materials for the operation of the Platform.

5. Permitted Use

Download individual items for personal use.

Users may not:

Copy or extract large portions of the database.

Republish Content on external websites, platforms, or publications.

Use automated tools to scrape, harvest, or extract data.

Misrepresent the Content as their own intellectual property.

6. User Conduct
Users must not:

Upload unlawful, defamatory, offensive, or infringing material.

Interfere with the security, functionality, or integrity of the Platform.

Attempt to gain unauthorised access to accounts, systems, or data.

The Platform may suspend or terminate accounts that violate these conditions.

7. Accuracy of Information

The Platform does not guarantee completeness, accuracy, or suitability for any specific project or site.

Users are responsible for verifying plant suitability, environmental conditions, and regulatory requirements.

The Platform is not liable for planting outcomes, design decisions, or project results.

8. Privacy and Data Handling
Personal information collected during registration and use of the Platform will be handled in accordance with the Platform’s Privacy Policy. Personal data will not be sold or disclosed to third parties except where required by law or necessary for Platform operation.

Users may request deletion of their account and associated personal data.

9. Availability of the Platform

10. Limitation of Liability

13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or the use of the Platform will be subject to the exclusive jurisdiction of the courts of Victoria.
